DHS spokesperson says arresting Democratic members of Congress is 'definitely on the table' after Newark ICE facility incident
On May 9, 2025, three Democratic House members from New Jersey — Bonnie Watson Coleman, Rob Menendez, and LaMonica McIver — conducted an unscheduled oversight visit to the Delaney Hall ICE detention facility in Newark. The visit coincided with the arrest of Newark Mayor Ras Baraka for alleged trespassing, and a physical confrontation followed as the lawmakers exited the facility gate with ICE and HSI officers. The next day, DHS spokesperson Tricia McLaughlin told CNN that when asked whether a member of Congress could be arrested in connection with the events, “This is an ongoing investigation, and that is definitely on the table.” McLaughlin also alleged that DHS held body-camera footage of members “body-slamming a female ICE officer” — a claim the three lawmakers contradicted, saying they witnessed no such violence, and which available video did not corroborate.
Members of Congress have a statutory right to enter ICE detention facilities to conduct oversight, and Rep. Jason Crow and others responded that arresting lawmakers for that lawful function could not legitimately be “on the table.” Rep. McIver was nonetheless federally charged for allegedly interfering with ICE agents during the visit. One of the threatened Democrats said DHS was creating an “environment of intimidation.”
Structurally, the “definitely on the table” statement marks an escalation in which the executive’s enforcement arm publicly floated the prospect of arresting sitting legislators for exercising their oversight authority — inverting the constitutional relationship in which Congress checks the executive.
