Larry Ellison Reported on Evening Call With Sekulow, Graham, Hannity and True the Vote Counsel Bopp About a Post-Election "Preliminary Report"
On the evening of Saturday, November 14, 2020, a week after the networks called the presidential race for Joe Biden, True the Vote founder Catherine Engelbrecht emailed donor Fred Eshelman at 10:45 P M (time zone not stated) that “Jim was on a call this evening with Jay Sekulow, Lindsey Graham, Sean Hannity, and Larry Ellison.” In her account, Jim “explained the work we were doing and they asked for a preliminary report asap, to be used to rally their troops internally, so that’s what I’m working on now.”
What is documented. The email is Exhibit 41 to Fair Fight’s May 16, 2022 summary-judgment motion in Fair Fight, Inc. v. True the Vote (N.D. Ga. 2:20-cv-00302-SCJ), Bates-stamped “Eshelman 00167.” It was produced by Eshelman, the donor. The email appears in the court record as a forward Eshelman sent on November 23, 2020 to Ronald Jacobs. The “Jim” is surnamed only in a separate November 16 email from Engelbrecht to Eshelman and “Jim Bopp” (Exhibit 40), which pairs Eshelman with Bopp as co-recipient. The Washington Post’s report, as relayed by the Denver Gazette/Washington Examiner, identifies him as James Bopp Jr., True the Vote’s lawyer.
What is not documented. Everything about the call itself comes second-hand: Engelbrecht relays what Bopp told her. The email does not say who initiated the call, how long it ran, what Ellison said or did, or whether anything came of the “preliminary report.” The Post and Reuters coverage does not establish Ellison’s role either. The Post (as summarized by secondary outlets; original paywalled, not fetched) reports that a participant said he may have been there to assess claims about voting machines, and that a Graham spokesman said Ellison was likely there because he supported the former president. Those statements are reported, not seen in the filing. Neither Reuters nor the Examiner reports any Oracle comment beyond “did not immediately respond.”
Date kinds. Call: evening of 2020-11-14 (per the email’s “this evening”). Email sent: 2020-11-14, 10:45 P M. Filed in court: 2022-05-16 (Fair Fight’s motion). Press report: 2022-05-20 (Post, Reuters).
Context in the same email. Engelbrecht describes “this new alignment” with “the Trump Team” and a cash summary of a $2.5 million donation, a $500,000 Bopp Law Firm advance, and a $1,000,000 payment to Old Town Digital Agency. She also describes four whistleblowers whose briefs True the Vote was “writing up… to give to Senator Graham and Cruz.” On November 16, 2020, Eshelman wrote that he was “physically sick after our call” and threatened to request a refund (Exhibit 40).
Premise correction. The task premise says the reporting came from the Eshelman v. True the Vote litigation. It did not: the email surfaced in Fair Fight’s federal case, though the document itself came from Eshelman’s production. A report that Eshelman asked about Ellison’s presence in a Nov. 16 email is carried by Denver Gazette/Examiner; the Nov. 16 emails in Exhibit 40 do not mention Ellison, and that point is not verified.
