Barr and Sessions Convene Carrier Executives on FBI Digital Telephony Bill, Per FBI Director Freeh's Later Account

  • On Mar. 18, 1992, Attorney General William Barr and FBI Director William Sessions chaired a meeting of major telecommunications-industry executives about the FBI’s digital telephony legislation, which Freeh’s statement says was announced on March 6, 1992. The account comes from FBI Director Louis Freeh’s prepared statement to Congress in 1994. It is the FBI’s version, and no carrier’s contemporaneous account of the meeting was found.
  • By that account, the executives asserted that the FBI “had been talking to the wrong people in industry.” Freeh wrote that law enforcement’s interface with carriers had historically run through the security “organization of the common carrier,” and that the FBI learned in 1990 that those security entities were “not routinely involved in the industry’s technology planning.”
  • Freeh also wrote that several executives indicated that “without some sort of mandate, such as legislation” their companies could not invest in solutions on their own.
  • The same statement describes how a wire intercept worked: law enforcement relies on the provider for “identifying the target’s wire pairs” and on the provider furnishing “leased lines” to carry the intercepted communications to a law-enforcement monitoring facility.

Research Gaps

  • The existing entry 1992-03-06–fbi-announces-digital-telephony-legislation needs checking against this record.
  • Whether any 1992 congressional hearing on the proposal was held is unconfirmed; a Congressional Record or committee-calendar check would settle it.
  • No carrier’s own account of the March 18, 1992 meeting was found.
